Terms of Service

1. The Service

The App is a storefront and management tool for travel eSIM data plans. eSIM data plans are provided as an external telecommunications service delivered by our third-party provider. When you purchase a plan, we place an order with the provider on your behalf and deliver the eSIM to your device as a QR code for installation.

The App lets you:

• browse destinations and data plans (prices are shown at checkout);
• pay for a plan securely (payments are processed by a third-party payment provider);
• install your eSIM via QR code;
• view active eSIMs and their data usage;
• top up data when needed.

2. Eligibility

You must be at least 18 years old (or the age of majority in your country) to use the Service. You need an unlocked, eSIM-compatible device and an internet connection to install an eSIM.

3. Orders and payment

• You check out as a guest; we do not create a user account.
• You provide an email address for the order. We use it only for your order record and related service communication.
• Prices are shown in the App before you pay. If a price changes between the quote and your payment, the order will not be processed at the old price; you will see the updated price.
• Payment is processed by a third-party payment provider (currently Stripe). Your card details are handled by that provider and never stored by us.

4. Delivery and activation

• Your eSIM is delivered as a QR code shown in the App once the order is confirmed. Follow the in-app instructions to install it.
• You are responsible for confirming that your device is eSIM-compatible and unlocked before purchase. The App includes a compatibility check for guidance.
• eSIM data plans are dependent on third-party carrier networks. We are not liable for carrier network coverage, outages, or changes to network terms.

5. Refunds and cancellations

• eSIM plans are digital services. Once an eSIM has been delivered and/or activated, it may not be refunded, except as required by applicable consumer law.
• If your payment is confirmed but we are unable to deliver your eSIM, you are entitled to a refund of the amount paid for that order.

6. Acceptable use

You agree not to:

• use the Service for any unlawful purpose;
• resell, sublicense, or otherwise redistribute the Service or eSIM plans without our written permission;
• attempt to disrupt, tamper with, or gain unauthorized access to the App, our backend, or our providers;
• use the Service in a way that violates our provider's or a carrier's terms.

7. Third-party services

The Service relies on third parties:

• eSIM Access (our eSIM provider) processes orders and delivers the eSIM.
• Stripe (currently) processes card payments.

Their use of data is described in our Privacy Policy. Their own terms may also apply to the parts they operate.

8. Intellectual property

The GoPocket brand, logo, app, and content are owned by or licensed to Milioti LLC. You receive a limited, non-exclusive, non-transferable right to use the App for its intended purpose. No other rights are granted.

9. Limitation of liability

To the maximum extent permitted by applicable law, Milioti LLC and its affiliates are not liable for indirect, incidental, special, or consequential damages, or for loss of profits or data, arising out of or in connection with the Service. Where the Service is provided through third-party carriers and networks, their performance is outside our control.

Nothing in these Terms limits rights that cannot be limited under applicable law, including mandatory consumer protections in your jurisdiction.

10. Termination

We may suspend or terminate access to the Service if you breach these Terms. You may stop using the Service at any time. Orders already placed remain subject to Section 5.

11. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms and update the "last updated" date. Continued use of the Service after changes constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, with mandatory consumer protections in your jurisdiction preserved. Any dispute will first be addressed through our support channel.
